1What these terms cover

These Terms of Use govern the BlueWave Technology websites at bluewavetech.io and bluewaveops.com, the private product tour we make available by invitation, and the sign-in gateway that hands a customer to their CaseTrace portal. Together we call these the Site.

By using the Site you agree to these terms. If you do not agree, do not use the Site.

2Who we are

The Site is operated by BlueWave Technology, Inc., an Oklahoma corporation, based in Tulsa, Oklahoma. CaseTrace is our product and our trademark.

3Using the Site

You may use the Site to learn about BlueWave and CaseTrace, to request a private tour, to reach us, and, if you are an authorized user of a customer account, to sign in to your portal.

You agree not to:

• scrape, crawl, harvest or bulk-download content from the Site by automated means, other than a public search engine indexing pages we have not asked it to skip
• probe, scan or test the security of the Site, or attempt to bypass any access control, without our prior written authorization
• use another person's credentials, share your own, or attempt to obtain a role or permission you were not granted
• misrepresent who you are or who you work for when you request access to anything on the Site
• interfere with the Site or with anyone else's use of it

Our Acceptable Use Policy sets out these and related rules in more detail and forms part of these terms.

4The private tour

Access to the private product tour is by invitation. When we grant it, the walkthrough is BlueWave confidential material shared with you to evaluate CaseTrace for your organization, and you accept the following before it plays:

• Do not record, screenshot or re-transmit it.
• Do not share your link. It is issued to you personally, and every play is logged under your name.
• Do not show it to anyone who builds or sells video analytics.
• Your name and the date are displayed on the video while it plays.
• Access ends after seven days or twenty-five plays, and BlueWave may end it sooner.

You confirm your acceptance by typing your name, which is your electronic signature under the E-SIGN Act and applicable state law. We keep a record of the exact wording you accepted, the time, and the name you entered.

5Accounts and sign-in

The sign-in gateway on the Site hands each customer to the portal for their edition. Access to a portal is granted and managed by the customer organization under its subscription. You are responsible for keeping your credentials confidential and for activity under your account, and you must tell your administrator promptly if you believe an account has been compromised.

6Content and intellectual property

The Site, its text, design, screenshots, video, marks and software belong to BlueWave or its licensors and are protected by copyright, trademark and patent law. BlueWave holds one issued U.S. patent (US 11,830,346 B2) and has three pending. You may view the Site and print pages for your own evaluation. Any other use, including reproducing screenshots or product imagery in other material, needs our written permission.

CaseTrace, FeatureTrace, ArticleTrace, SceneTrace, ReTrace, ThreadTrace, SafeScope and the BlueWave name and wordmark are trademarks of BlueWave Technology, Inc. Other names on the Site belong to their owners and appear only to describe integrations and the industry.

If you send us feedback or suggestions we may use them without restriction or obligation, and we will not name you as their source without your permission.

7What the Site does not do

The Site describes a documentation and evidence platform. It is not the platform. Nothing on the Site creates a customer relationship, a duty on BlueWave's part to monitor, review, investigate, respond to or act on anything, or a warranty about outcomes. CaseTrace does not identify people, does not prevent theft, loss, injury or crime, and does not make anyone compliant with law. Where the product surfaces a Similarity Result it is a computational comparison for a human to consider and never an identification.

Screens and figures shown on the Site are captures from the product with demonstration data. They illustrate the product as it runs and are not a representation about any particular customer, environment or result.

8Third-party links and services

The Site links to and relies on services operated by others, including Netlify, Stripe, Dropbox Sign, Google Maps Platform and the email service we use to reply to you. Their terms govern their services. We are not responsible for their content, availability or acts.

9Disclaimer and limitation of liability

THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLUEWAVE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, AND DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLUEWAVE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, REVENUE, GOODWILL OR DATA, ARISING FROM YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY. BLUEWAVE'S TOTAL LIABILITY ARISING FROM THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITS, SO SOME MAY NOT APPLY TO YOU.

Liability under a CaseTrace subscription is governed by the subscription's contract documents, not by this section.

10Suspension and termination

We may suspend or end your access to any part of the Site, including a tour link or the sign-in gateway, at any time to address a security threat, unlawful or unauthorized use, a breach of these terms, or a risk to the Site or others. Suspension of a portal account is governed by the customer's subscription.

11Governing law

Oklahoma law governs these terms without regard to conflict-of-law rules. The state and federal courts located in Tulsa County, Oklahoma have exclusive jurisdiction over any dispute arising from the Site, and you consent to venue there.

12Changes

We may update these terms. The effective date at the top of this page is the date of the current version. Continued use of the Site after a change is acceptance of the change. We keep prior versions and will provide one on request.
